    UPDATE- 7/29/25

    On June 18, 2025 the U.S. District Court for the Northern District of Texas issued on order vacating the HIPAA Privacy Rule to Support Reproductive Health Care Privacy.  The court found that the rule unlawfully limits state public health laws, redefines terms like “person” and “healthcare,” and was adopted without congressional authority. This ruling applies nationwide and vacates the entire 2024 Reproductive Healthcare Privacy Rule, except for amendments to substance abuse disorder regulations.

    Medical examiner and coroner offices should receive medical records in absence of the HIPAA Privacy Rule. States have codes in place that allow medical examiners and coroners to obtain medical records, by law. For those offices recently struggling with obtaining records in a timely manner, there is no longer an attestation requirement for medical records.



    June 25, 2024, a modification to the HIPAA privacy rule was finalized which protects reproductive healthcare right from legal action, with a compliance date of December 22, 2024.
